GENERAL TERMS AND CONDITIONS

  1. Scope and Introduction

These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the contractual relationship between the Seller and the Buyer, unless otherwise expressly agreed in writing or confirmed by formal acceptance of an offer.

The Buyer shall be deemed to have read, understood and accepted these GTC once they are published on the Seller’s official website or otherwise made available to the Buyer prior to the conclusion of the contract.

Important notice: These GTC do not exclude or limit any mandatory statutory rights of consumers, where applicable.

  1. General Provisions

All agreements, offers, order confirmations and other arrangements between the Seller and the Buyer shall be made in writing. Communication by e-mail shall be deemed to constitute written form.

Oral agreements shall be legally binding only if subsequently confirmed in writing.

Any general terms and conditions of the Buyer shall not apply unless expressly accepted in writing by the Seller.

  1. Measurement, Offer and Order Confirmation

The Seller shall be responsible for the dimensional accuracy of the delivered products only if the measurement has been carried out by the Seller. If measurements are provided by the Buyer, the Buyer shall bear full responsibility for their accuracy.

The Buyer shall provide all necessary information (height, length, width, joint direction, material type, colour, etc.) and shall notify the Seller of any obstacles (hidden installations, plumbing, electrical wiring). Any additional costs or damages resulting from incomplete or incorrect information shall be borne by the Buyer.

An offer shall be valid exclusively for the items, quantities and descriptions expressly stated therein. The Buyer is obliged to carefully review the offer prior to order confirmation.

The validity period of an offer shall be stated in the offer itself. The issuance of a new offer shall replace and cancel any previous offer in full.

Drawings and sketches shall be deemed to represent an “inside view” unless expressly stated otherwise.

Substructure battens are generally not included in the measurements, but shall form an integral part of the product if indicated in the offer.

Written order confirmation, payment of a down payment or settlement of a pro forma invoice shall constitute acceptance of the offer and these GTC.

Order modifications shall be permitted only within 1 (one) working day of written order confirmation and must be made exclusively in writing.

The Seller reserves the right to make minor technical or structural modifications for regulatory or technical reasons, provided that the agreed functionality and quality are not adversely affected.

The cost of on-site measurement shall amount to EUR 50, unless otherwise stated in the offer; in the event of order confirmation, this cost may be credited against the final purchase price.

If payment is not made within 15 days of receipt of the final pro forma invoice, the order shall be deemed cancelled.

  1. Prices and Payment

All prices are stated in EUR and exclude VAT, unless expressly stated otherwise.

The Seller reserves the right to adjust prices in the event of changes to quantities, materials or technical specifications relevant to the price calculation.

Discounts shall not be cumulative unless expressly agreed in writing.

Payments shall be made exclusively by bank transfer to the Seller’s designated bank account.

Representatives, installers or other agents are not authorised to accept cash payments.

Invoices shall be paid within 8 days from the date of issuance, unless otherwise agreed in writing.

In the event of late payment, the Seller shall be entitled to charge statutory default interest in accordance with applicable law.

  1. Value Added Tax (VAT)

Standard VAT rate: Slovenia and Italy: 22%. Croatia 25% VAT.

A reduced VAT rate may apply to certain installation services, provided that all statutory conditions are fulfilled.

VAT-registered Buyers shall provide accurate tax details, including VAT ID, at the time of ordering.

  1. Payment Terms

Retail sales (B2C):
Payment terms shall be agreed individually and specified in the offer or pro forma invoice.

Wholesale sales (B2B):
Unless otherwise agreed by contract, 100% advance payment shall apply.

  1. Delivery and Delivery Times

The indicative delivery time for standard products shall be 4–7 weeks, unless otherwise stated.

Delivery periods shall commence only after order confirmation, completion of measurement (if applicable) and receipt of payment in accordance with the agreed terms.

Delays caused by technical reasons or mutually agreed changes shall not entitle the Buyer to claim compensation.

The Buyer shall inspect the goods upon delivery and immediately notify the Seller of any visible defects.

  1. Transfer of Risk and Collection

Goods ready for collection shall be collected within 8 days of notification by the Seller.

Upon expiry of this period, the Seller shall be entitled to charge storage costs amounting to 0.1% of the order value per day.

The risk of accidental loss or damage shall pass to the Buyer upon delivery or upon the goods being made available for collection.

  1. Retention of Title

The goods shall remain the property of the Seller until full payment of the agreed purchase price has been received.

  1. Warranty and Liability

The warranty shall not cover defects resulting from improper use, unauthorised installation or inadequate maintenance.

Warranty for carpentry/parquet works: 1 year.

Warranty for installation of Evodecking: 5 years.

Warranty for Evodecking material: 5 years.

The warranty shall not affect any mandatory statutory rights of consumers.

  1. Complaints

Complaints shall be submitted in writing and shall include a detailed description of the defect, photographic documentation, invoice and proof of payment. If a complaint is justified, the Seller shall propose an appropriate remedy.

  1. Installation Conditions

The Buyer shall ensure free access to the site, electrical power supply (220 V) and safe working conditions. Electrical installations and connections are not provided by the Seller.

  1. Personal Data Protection

Personal data shall be processed in accordance with Regulation (EU) 2016/679 (GDPR) solely for contractual and statutory purposes.

  1. Jurisdiction

For B2B transactions, the court with subject-matter jurisdiction in Ljubljana Slovenia ( or Šibenik Croatia) shall have exclusive jurisdiction.
For consumers, mandatory statutory jurisdiction rules shall apply.

  1. Entry into Force

These General Terms and Conditions shall enter into force on 01 January 2025 and shall be publicly available on the website decklab.eu.
